Newly unsealed court documents from Authors Guild v. OpenAI reveal that both OpenAI and Microsoft executives knowingly trained their AI models on pirated books (including all sorts of art theft) while privately admitting that the technology threatens writers' livelihoods. Remember Aaron Swartz and the tragic fate he suffered? Remember the kids who downloaded games or MP3 files, whose parents were threatened, and in some cases, extorted for money under copyright laws? Yes, where are those copyright laws now? Why are courts and governments now giving a free pass to filthy rich OpenAI, Microsoft, Google & Anthropic? I hate everything about this dual treatments. These AI companies even have audacity to tell others their AI output is copyrighted & others can't use it

@nixCraft Very very true. Everything we create is fed into giant LLM's and moneytized without our consent. In corporations there now are companies that are too big to fail, and also too big to ever break the law.

I'm not sure "free pass" quite hits the mark, because copyright is fundamentally about regulating a (profit-oriented) market. If the fundamental principle remains profit-oriented competition, then if another market comes along (in this case "AI"), there are systemic reasons that cause nations to shape legal systems in this way. The quintessential point is that we care about more than just profit and this conflicts with a system of production aimed exclusively at accumulation of profit.

@nixCraft the travesty is not AI companies making fair use of copyrighted material, it's that you have so internalized the copyright lobby's arguments that you think copyright law overreach is legitimate in the first place. Aaron should never have been prosecuted at all, and in fact neither MIT nor the copyright holders wanted him to be, it was an ambitious Federal prosecutor looking for a scalp to build a political career out of. She got the scalp, but not the career.

@AlisonW @nixCraft Copyright law has an exception for uses that are "transformative". So, if you download every book you can find and pipe them into a program that builds a database of
word-use frequency, you are OK. If you learn to write novels by first reading a lot of novels, if only to learn how novels are structured, that is OK. AI companies are claiming this is basically what they are doing and authors are claiming their work is merely being spit out.

@nixCraft IANAL, but I think these executives either knew or got consultation about the differences between civil and criminal law.
If they broke criminal law, they would risk going to jail, but if they broke civil law, they would only have to make it up later in financial penalties*.
I think that's the key.
* - and not even themselves, essentially OPM.

@ckd That's not how it works anymore, they gave OpenAI a 300 billion dollar valuation. All Sam Altman and his cronies have to do is take out loans on that valuation and then they don't even have to pay taxes because they "lost money" paying those loans. It's all a scam

@nixCraft it's interesting how the government threw the book at all the citizens (and Kim Dotcom) when all this stuff was on their servers but now all of the sudden because OpenAI has more money and are the ones giving them the kickbacks they're not so aggressive anymore

Our granddaughter has great talent as an artist. At just 15 she’s produced some amazing work, in several different genres.It’s what she loves doing yet I wonder if there’ll be any kind of career for her in the parasitic world of AI.
