I'm not sure "free pass" quite hits the mark, because copyright is fundamentally about regulating a (profit-oriented) market. If the fundamental principle remains profit-oriented competition, then if another market comes along (in this case "AI"), there are systemic reasons that cause nations to shape legal systems in this way. The quintessential point is that we care about more than just profit and this conflicts with a system of production aimed exclusively at accumulation of profit.
