Yesterday’s SCOTUS decision in Ames v Ohio Dept. of Youth Services is absolutely going to open a host of discrimination flood gates - the good kind.
Don’t get me wrong, I am hella sus about Ames’ own claims (speaking as a gay man myself) and there’s very clear bankrolling of these suits by Christofascist thugs and/or their allies (“Conservative Legal Advocates”) to try and hurt queer people. But SCOTUS flung the door open in general on this one, in a way that I don’t think they appreciate.
An excellent example is this lawsuit against IBM: https://www.universalhub.com/2025/boston-woman-charges-she-didnt-get-executive-job-ibm-because-shes
In tech especially, there’s been a continuous shift towards foreign leaders and foreign staff for domestic companies or roles - not just simple outsourcing, but full-on replacement and exporting of US labor with non-nationals. Proving this under T7 in the past has been an insurmountable hurdle thus far, because US nationals are the majority.
With that higher burden gone, expect a lot more lawsuits.
