    Hey Germany. Your constitution says that Nazi parties are illegal. It does not say that they are only illegal if they don't have a lot of voter support and it could lead to serious trouble if you closed them down.

    You need to ban AfD or change your constitution to allow Nazi parties. The world keenly wants to know which option you prefer.

    @mrundkvist You are absolutely right!

    Just wondering whether the World really can't wait to find out, remembering the last time they found out.

    As a german, may I suggest you all prepare to make D-Day happen right at the start, this time?

    Some of us will go underground soon to prepare the field, ok?

    @mrundkvist
    As I read German law, the federal government, the Bundestag (lower house) and the Bundesrat (upper house) may each ask the Federal Constitutional Court to ban a party (Art. 21 Basic Law, § 43 of the Court’s statute). None of them is obliged to do so.

    So not starting the process is constitutional, although there are good reasons to want it started.

    @mrundkvist @martin_ueding well yes, the Verfassungsschutz is tasked with blowing the whistle. It has done so even though it is notorious for being focused on left extremism and blind for right extremism.

    However, nobody is obliged to act upon the whistle. Merz (and also the social democrats) keep saying that you have to defeat them politically, not using the courts.

    @mrundkvist quite the opposite, in fact: in the past Nazi parties have been _not banned_ with the ruling explicitely stating that even though they violate the constitution they have too little voter support and probably are not serious trouble. So it doesn't get more illegal than the current Nazi party.
