There was one point where the NetBSD Project tried to hijack the NetBSD Foundation (or vice versa, I forget which is which), where essentially vendor stuff tried to take over the code and development, and that was a battle. Fighting private enclosure of the commons is a never ending battle and you're right that moving tech doesn't automatically solve that.
